PBS draws link between digital music rights and magic spells, somehow makes it look simple video

AAC files and the arcane don't have much in common on the surface. After some digging, however, PBS' Idea Channel has found that magic is an uncannily good analogy for digital music rights and explaining the thorny ethical issues that come with them. Both music and spells stem from grassroots cultures that give away their content for free, but (at least until an anti-magic clampdown at eBay) have since become businesses. That nature poses a key ethical question: when we're used to a free experience and can copy songs or spells as much as we like, what does it take to keep us as honest customers? As show host Mike Rugnetta suggests, it's a matter of personal responsibility -- if we want more of either, we have to think of the commerce as showing support for future work. You can catch Mike's clever train of thought after the break, and ponder what constitutes DRM for a potion while you're at it.

Eto'o makes himself available again for Cameroon

YAOUNDE, Cameroon (AP) -Samuel Eto'o was ready to return to the Cameroon national team Friday after being asked by the country's government to end his boycott.

The 31-year-old striker said on his website that he had made himself available again for selection "on the request of the highest authority of the Republic" after a self-imposed exile in protest against poor organization within the squad.

Eto'o met with Cameroon's prime minister, the minister of sports and also new coach Jean Paul Akon this week to discuss his return ahead of a decisive African Cup of Nations qualifying game next month.

The meeting was held on the instruction of the country's president, Paul Biya, to ensure Cameroon's former captain and the four-time African footballer of the year was back in the team with Cameroon in danger of missing out on a second straight African Cup of Nations tournament.

"I am encouraged by my desire to serve my country with the same faith and determination as the last 15 years," the Russia-based forward wrote on his website in announcing his comeback.

Having served an eight-month suspension for his part in a players' strike last year, Eto'o refused to play in this month's 2-0 loss to Cape Verde in the final round of African Cup qualifiers as a further protest against what he called the "amateur" national federation.

The second leg against Cape Verde is at home in Yaounde on Oct. 14, with a place at next year's African championship in South Africa on the line.

The former Barcelona and Inter Milan striker was apparently convinced to return for that crucial game following the firing of Frenchman Denis Lavagne as coach after the loss in Cape Verde and the return of Akon, who led Cameroon to the Olympic title as coach in 2000. Eto'o also played on that team.

Cameroon is a four-time African Cup winner, with Eto'o part of the squad for two of those titles, in 2000 and 2002. He has played 109 times for his country and scored 53 goals.

Note to tweeting #Romney, #Obama campaigns and #journalists: Chill

Believing that faster is better, journalists and political figures feel constant pressure to express themselves at the speed of a tweet. The resulting commentary is long on reflex and short on reflection, and harms public discourse. There's an answer: Slow down.

By John J. Pitney Jr. / September 28, 2012

Protesters confront tear gas along a road which leads to the US embassy in Cairo Sept.13. Op-ed contributor John J. Pitney Jr. writes: 'A shrill feedback cycle is at work: Hasty reactions to hasty reactions to hasty reactions. Without clearance from the State Department, a diplomat in Egypt rushes to tweet about an anti-Islam YouTube video. The Romney campaign rushes to attack the tweet. The Obama campaign rushes to criticize the Romney attack. Journalists rush to weigh the political consequences of the campaign exchange.'

Smartphones and iPads, Twitter and Tumblr ? such things have vastly increased the speed and reach of communications. Almost as soon a thought enters your mind, you can send it everywhere.

' + google_ads[0].line2 + '
' + google_ads[0].line3 + '

'; } else if (google_ads.length > 1) { ad_unit += ''; } } document.getElementById("ad_unit").innerHTML += ad_unit; google_adnum += google_ads.length; return; } var google_adnum = 0; google_ad_client = "pub-6743622525202572"; google_ad_output = 'js'; google_max_num_ads = '1'; google_feedback = "on"; google_ad_type = "text"; google_adtest = "on"; google_image_size = '230x105'; google_skip = '0'; // -->

That ability can be hugely beneficial ? but also harmful, particularly in politics.

Twitter-like thinking ? the kind that relies on quick intuition and impulse ? can work well when we?re playing sports, for instance. Athletes develop a sense of when they can score a goal or steal third base without doing cost-benefit analyses.

Public life is different. Impulse reacting draws on stereotypes and mental shortcuts that can mislead us when we apply them to political questions. It is better to engage a more deliberative and reasoned approach, thinking things through and seeking additional information.

For instance, picture Federal Reserve Chairman Ben Bernanke announcing another effort to inject money into the economy. Reasoned thinking may tell us to study the effects of previous efforts. Twitter-think may tell us automatically to accept or reject whatever the Fed chairman says, whatever the quality of his argument. Or it may just tell us never to trust a guy with a beard.

Despite its obvious defects, impulse thinking often prevails in the new world of instant communications. Believing that faster is better, journalists and political figures feel constant pressure to express themselves on anything and everything at the speed of a mouse click. The resulting commentary is long on reflex and short on reflection.

A shrill feedback cycle is at work: Hasty reactions to hasty reactions to hasty reactions. Without clearance from the State Department, a diplomat in Egypt rushes to tweet about an anti-Islam YouTube video. The Romney campaign rushes to attack the tweet. The Obama campaign rushes to criticize the Romney attack. Journalists rush to weigh the political consequences of the campaign exchange. For days, meanwhile, serious questions about terrorism and embassy security get too little attention.

Political polarization heats up when discourse moves faster than the speed of rational thought. Given a chance to consider an issue carefully, people may see the strengths and weaknesses of each side. But when they respond immediately, they will cheer for the home team and boo the opposition.

Argument preview: Defining a houseboat ? a house or a boat ...

The Supreme Court at 11 a.m. on Monday will hold one hour of oral argument on how to define a ?vessel? for purposes of moving a dispute over a floating structure?into the special court that handles maritime commerce.?? Arguing first in the case of Lozman v. Riviera Beach, Fla. will be Stanford law professor Jeffrey L. Fisher, representing the owner of a houseboat that was at the center of the dispute,?Fane Lozman.??Fisher will have twenty minutes of time.? Partly supporting Lozman, Curtis E. Gannon, an Assistant to the U.S. Solicitor General, will argue for the federal government as an amicus, with ten minutes of time.? The Florida city will be represented by David C. Frederick of the Washington office of Kellogg, Huber, Hansen, Todd, Evans & Figel, with thirty minutes of time.

?????????

Background

The dispute in this case, in its basic facts, hardly seems like the stuff of a significant Supreme Court case.? It involves a rather ordinary running feud between a quite cantankerous local citizen and a city government, with each side highly suspicious of the other?s motives, and seemingly determined to fight out each phase of their spat until the bitter end; something, perhaps, that ?Judge Judy? could easily handle.?? And the central object in the case was (until it was destroyed by the city) a plywood floating vessel that Fane Lozman made his home; in court papers, it gets this formal designation: ?that certain unnamed gray, two story vessel approximately fifty-seven feet in length, her engines, tackle, apparel, furniture, equipment, and all other necessaries, appertaining and belonging in rem.?? The ?in rem? means that the city of Riviera Beach?s lawsuit is against the vessel itself, not against its owner, Lozman.

Still, the case does rank as worthy of the Supreme Court because there is a significant legal principle at stake.??The case will require the Court to spell out when a floating structure qualifies, legally, as a ?vessel,? such that a dispute in which it is involved must be resolved in admiralty court under special rules of maritime law.?? The case has attracted the interest of the federal government, as well as of groups whose members?make their living in marine industries, plus lawyers in the specialized field of maritime law, owners of houseboats, and even the operators of riverboat casinos.?? They all will be affected by how the Court defines ?vessel.?

There would have been no case, though, if Fane Lozman and the city of Riviera Beach had worked out their differences on whether Lozman was paying what he supposedly owed for using city utilities in his floating home, and if Lozman had not suspected that the city was acting lawlessly in trying to sneak through a plan to redevelop the marina where his home was tied up at?a dock.?? The feud has made for ongoing, lively coverage in local newspapers, with Lozman sometimes portrayed as the?Biblical?David to the city?s Goliath.

Lozman, whom the city?s lawyers have sought to belittle by suggesting that he is a millionaire quibbling over a few thousand dollars, bought his floating home in 2002.? A residence seemed to be its only practical use: it was not made to?navigate in waterways, because it had no bilge pumps, no steering mechanism, no navigation aids, no lifeboats or other rescue equipment, no propulsion, and a square bow that did not make for smooth plowing through waves.?? It had no Coast Guard hull number, so it could not be registered for operation as a boat.?? Lozman lived in it for three years at dockside in North Bay Village in Florida.? It was damaged in Hurricane Wilma in 2005, and Lozman decided to move it to Riviera Beach.?? It was towed there, and he then tied it up at a marina run by the city.? It had power and sewer lines reaching to the dock, and connections for cable TV and Internet access.?? He signed a lease in March 2006 with the city, intending to live in the structure indefinitely.

Trouble with the city began soon, after he had filed a lawsuit against the city, claiming it was attempting to sell the marina to private developers, but in doing so had violated the state?s open meetings law.? His lawsuit also contended that the city was abusing its power to seize private property for public use.? The city?s redevelopment plan fell through.?? On the premise that his dog ? a small?dachshund ??was not muzzled, the city ordered him evicted from its marina.? The city also claimed he was using unlicensed workmen to do work on the houseboat.?? The jury in his lawsuit ruled for him, and included in its ruling a finding that he had been the target of improper retaliation for speaking out against city policies.? The next move was the city?s, adopting a new marina docking agreement with more stringent conditions.?? Among the new conditions was a requirement that any vessel in the marina be fitted so that it could be moved in an emergency;?Lozman would have to leave the marina unless he complied, the city said.?? Lozman refused to sign.

The city then filed a claim against Lozman in admiralty court.? The reason: a federal law provides that anyone who provides ?necessaries? to a ?vessel? establishes the right to collect what is owed for those materials or services, and a right to sue in admiralty court directly against the vessel (the ?res?) to enforce the lien covering the amount due.?? The city contended that Lozman owed $3,039.88?in unpaid dockage fees.?? When a maritime lien is submitted for collection, the floating object to which the lien attaches is ?arrested? by a U.S. marshal and is taken into what amounts to custody.? That is what happened to Lozman?s houseboat.

A judge ruled for the city, and ordered the houseboat sold at an auction.? Someone acting for Lozman put in a bid, but the city topped it with a bid of $4,100.? It thus took possession of the houseboat.? City officials later said they tried to sell it or give it away, but, when such efforts failed, the city destroyed it.?? City officials now claim, through their lawyers, that they spent more than $32,000 in moving and maintaining the houseboat after it was ?arrested.?? In fact, the city?s lawyers have told the Supreme Court that, after the case is over, they may sue Lozman to recover some of the money they spent after they took over the houseboat.?? In the meantime, the city has posted in federal court a $25,000 bond in case Lozman ultimately wins.

(After the Supreme Court had agreed to hear Lozman?s appeal, claiming that the case should never have gone into admiralty court because, he argued, his houseboat was not a ?vessel? under maritime law, the Supreme Court noticed that the vessel had been sold and later destroyed.? It asked all of the lawyers involved in the case whether that made the dispute a dead one; all of the lawyers filed new briefs arguing that, under traditional maritime law principles, the fate of?a floating structure did not ?moot? a controversy over it, especially when money had been put up as a substitute for the structure.? Whether the Court will accept that argument is up to the Justices; if they don?t, the case could end without a ruling.)

The ruling against Lozman in the admiralty court was upheld by the Eleventh Circuit Court.? It ruled that the houseboat was, legally, a ?vessel? under maritime law.? It relied on an opinion it had issued in 2008, which held in a floating casino case that a watercraft capable of being towed on the water without sinking was capable of maritime transport, even if it could not propel itself, and thus qualified as a vessel.

Petition for Certiorari

Lozman?s lawyers filed a petition for review in November of last year, raising the single issue of whether a floating structure indefinitely tied to a dock but not intended for use in marine commerce was a vessel, which would make?it eligible for its fate to be resolved under maritime law in admiralty court.? The petition made two arguments: first, that the lower federal and state courts?had reached conflicting results on the definition of a ?vessel,? and, second, that the legal dispute was over ?a pivotal question of federal maritime law.?

On the conflict issue, Lozman?s counsel contended that the Eleventh Circuit?s sole focus on whether a floating structure could be towed without sinking was contradicted by rulings of the Fifth and Seventh Circuits, both of which have focused upon the owner?s intended and actual use of such a structure.?? If the Eleventh Circuit view prevailed, the petition argued, it would mean that ?a wooden garage door? in the water could qualify as a vessel ? a suggestion that Justice Stephen G. Breyer had put forth during oral argument in another case in?2005.? This case,?the petition said, should be granted to ?put an end to this overly expansive test.?

On the impact of the dispute, the petition said the outcome of the case could affect ?innumerable private and commercial owners of such structures,? and could affect ?the regulatory ability of state and local governments across the country.?

Lozman?s petition drew the support of the Maritime Law Association of the U.S., which argued that the conflicting interpretations of the word ?vessel? in maritime law ?creates substantial uncertainty for maritime entities, and those who advise them, about what standards and rules apply to floating structures.?? Litigation will be prolonged if that is not resolved in a uniform way, the association contended.

The city of Riviera Beach opposed Supreme Court review, arguing that the dispute was limited to the specific facts and circumstances of the controversy between Lozman and the city as the marina operator.? Even Lozman had conceded, the opposition brief argued, that the case turned on the specific facts about how his structure was linked to the shore at the marina.? Thus, the city contended, the case was a poor vehicle for confronting the legal definition of ?vessel.?? Moreover, it accused Lozman?s lawyers of misstating the facts in an attempt to try to make the case seem broader than it actually was.

The Court granted review of the case on February 21, after just one look at it at Conference.? The Justices probably were satisfied that there was, indeed, a conflict among the lower courts on an issue of some consequence to maritime law.

Briefs on the Merits

Lozman?s brief on the merits is a combination of reliance on the words of the federal law defining ?vessel? and on the pragmatic issue of how a floating structure is intended to be used.? Under federal law, a vessel is defined as ?every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on water.?? That definition, the brief argued, puts the focus both on the function ? transportation on water ? and the actual use.? Lozman?s home, it added, ?was not designed or used to move people or goods over water.?? A theme that runs throughout the brief is that a structure like Lozman?s houseboat is, in essence, an extension of the land, not a watercraft.

The brief sought to draw a distinction between a ?houseboat? and a ?floating home.??? The former does provide living accommodations, but also is intended to be moved over water under its own power, while the latter is used as a residence, and nothing more, according to the brief.? The document also stressed that the two kinds of floating living arrangements are financed differently and taxed differently when sold.? Describing in detail the physical structure of his floating home, Lozman?s brief noted that it had French doors on four sides and was only a few feet above the water and thus potentially subject to being swamped when moved.

On the legal side of the dispute, Lozman?s lawyers argued that Supreme Court precedents dating back to the nineteenth century hold that the purpose of a structure determined whether it is capable of serving as a means of transportation over water.? A floating home?does not fall within the description of vessels in?those precedents, the brief argued, because it performs its function ?by sitting still.?

The brief also argued that the special principles and benefits of maritime law, geared to the needs of actual maritime commerce involving moving vessels carrying goods or people, are ill-suited to governing disputes over floating structures that are more or less permanently moored to a dock and serving purposes other than maritime commerce.

The city of Riviera Beach, in its brief on the merits, argued that the proper test ? one that it said the Eleventh Circuit had correctly applied in this case ? is one of ?practical capability.??? It noted that Lozman?s houseboat had been towed over water for ?hundreds of miles,? and thus was capable of being transported.? It also noted that the houseboat was capable of, and did, leave the marina in ?a matter of minutes.?? Its links to the dock, the brief asserted, were ?so flimsy? that they could not be an impediment to transporting it to another location in another waterway.? Lozman had no legal right to remain indefinitely at a docket in the marina, so his attempt to claim it as an extension of the land was incorrect, the brief said.

Arguing that the key Supreme Court precedent in 2005, Stewart v. Dutra Construction Co., embraced the definition of vessel according to its ?practical possibility,? the city?s brief said it is important ? since the definition of vessel is related to court authority to resolve disputes over vessels ? to have a simple jurisdictional rule that is easy to apply.? It contended?that ?a practical-capability test is easy to apply.?? In?most cases, it added, ?a watercraft that can float, carry objects, and be towed over water will qualify as?a ?vessel.??

By contrast, it asserted, using Lozman?s test of the owner?s purpose ?would spawn confusion and gamesmanship.?? That test would turn on what each owner subjectively intended for the floating structure, and thus would enable?an owner ?to maneuver his craft in and out of vessel status.?

The Obama Administration has joined in the case, mostly but not entirely on Lozman?s side.? The federal interest in the case, the government?s merits brief said, is engaged because the definition of ?vessel? affects the working rights of those who labor aboard watercraft, and because the government has an obligation to inspect many types of floating structures and in working to promote ?a viable and health maritime transportation industry.?

The government contended that ?the mere ability to float and be towed across water? is not enough to establish a structure as ?a vessel? under maritime law.? Thus, it partially endorsed the ?purpose or function? test that Lozman put forth.?? But the federal brief parts company with Lozman?s contention that the owner?s intent should be of major influence.? In that regard, it suggested that the use of ?objective criteria? to determine whether a structure is a vessel would assist in determining a structure?s ?practical capability.??? Among the ?objective criteria? that it argued should be applied were whether the structure has ?practical access to navigable water,? how it is tied up to the shore, whether it can withstand the hazards of navigating, and whether it can leave a mooring within a matter of a few hours.? The Circuit Court was wrong, it contended, in denying the relevance of virtually all of those criteria.

The federal brief did not urge the Court to rule in Lozman?s favor explicitly.? It called for the Court to vacate the Eleventh Circuit ruling, and send the case back to determine the status of Lozman?s structure using the tests the federal argument suggested.

Analysis

Although the briefing in this case appears to suggest that the Court in the end needs to adopt one legal test or another, the Justices may well find that the outcome turns on the meaning of three words in the federal law that defines ?vessel.?? Those words are ?means of transportation.? That would seem to put the focus squarely upon the mobility of a floating structure.?? That would appear to be more a matter of function than of human intention, and could be informed by what actual navigation requires.?? It would not take an expert in naval architecture to determine what the rigors of the sea demand of a vessel.

While Lozman would get at the question in significant part?by focusing on the owner?s intent, supported by the nature of the physical link to the shore, and while the city of Riviera Beach would get at the question by focusing on towability, neither seems to get really?close to the transportation issue.? The federal government?s multi-factor proposal might well be closer to the status of transportability.? The government approach would clearly rule out the ?floating garage door? that Lozman fears might qualify as a ?vessel? if towability is the standard.?It also would tend, it seems, to support the idea that a houseboat ? or, if one prefers, a floating home ? ordinarily should look and act more like a boat before it can be treated as a ?vessel.?

As a?legal matter,?the case probably turns more on a simple question of statutory interpretation, and not on the Court?s past precedents, which seem to point in a variety?of different directions.

This case in plain English:

It is a very long tradition that legal controversies over boats and their role in transporting people and goods are better decided in a specialized court that focuses only on those issues.?? It is called an admiralty court and it makes its decisions according to maritime law ? essentially, legal standards that govern the business of transportation by sea.??Admiralty law?actually dates back before Roman times, but also is very modern in the sense that it deals with such things as liability for oil spills, for example.? Many such disputes involve the rights of sailors, or others who work abroad floating structures.

In the Florida case now before the Supreme Court, the issue turns on when a dispute over a floating structure can be filed and decided in an admiralty court.? Such a case?must involve a ?vessel,? but the federal law that defines ?vessel? is not very precise.?? It focuses on a structure that can work as a ?means of transportation.??? The Supreme Court has spent generations of time and effort trying to sort out what a ?vessel? is, in legal terms.?? Is a barge a ?vessel??? Is an oil platform with a fixed position in the ocean a ?vessel??? And now the Court is faced with deciding whether a houseboat, or a ?floating home,? is a ?vessel.?

Many houseboats, of course, have engines and are built in such a way that they can move about over water, carrying occupants in a way that is quite similar to?motor homes operating?on the highway.???There is no doubt that such a powered and moving conveyance qualifies legally as a ?vessel.?? But not every floating home is actually a boat, in the sense of having?an engine, a steering mechanism such?as a rudder, or electronic or manual devices that help trace the location of the structure on the water the way a modern GPS does for a car or truck.?? The houseboat?that was in the center of the Florida case has none of those hallmarks of a boat.? If it moved at all, it could do so only if it was towed, as it was several times.? Is that enough to make it?a ?vessel,? legally speaking?? In addition, that particular structure was tied up to a dock, and the owner?intended to leave it there and live in it as his home.? Is that intention enough to prove that it is not a??vessel??

This particular houseboat was?surrounded by controversy because it was tied up in a marina run by the city of Riviera Beach, Fla., and the city contended that the owner did not pay the full fees for keeping it there.?? So the city sued the boat?itself ? that is one of the peculiar facets of maritime law, the boat is treated as if it had its own legal personality ? and asked the admiralty court to rule that the owner had to pay up, or else forfeit the houseboat to the city.?? The court ruled for the city, ordered the boat sold at auction, with the result that the city bid for it, and won ownership.? After failing to sell it or give it away, it destroyed the houseboat.? The controversy goes on ? and this is another peculiar thing about maritime law ? because the destruction of the floating structure does not put an end to the case, if there is anything left legally to decide.?? Here, there is something left to decide: who gets some or all of the $25,000 in?funds that the city?paid into a court account, in case it should ultimately lose the case in a court decision?that the houseboat was not?a ?vessel? after all, so the dispute should not have gone to admiralty court in the first place.

The owner of the now-destroyed houseboat may yet get some of that deposited amount, if he wins.

Hillary Clinton drops hint that Al Qaeda was behind Libya attack

Secretary of State Hillary Rodham Clinton on Wednesday suggested a link between Al Qaeda and the Sept. 11 attack on the US consulate in Benghazi, Libya, going further than other Obama administration officials have previously in asserting that the deadly attack involved terrorists.

Speaking at a special United Nations meeting on instability in the Sahel ? the African region that includes Mali, where Islamist extremists control the north of the country ? Secretary Clinton cited the Libya attack as an example of the kind of action the region?s growing extremist groups are carrying out.

"What is happening inside Mali is augmented by the rising threat from violent extremism across the region,? Clinton said, adding that groups including Al Qaeda in the Islamic Maghreb have launched attacks from northern Mali into neighboring countries. These same groups, she added, ?are working with other violent extremists to undermine the democratic transitions underway in North Africa, as we tragically saw in Benghazi.?

The White House last week said it was ?self-evident? that the Benghazi attack was ?terrorism,? but Republican critics have said the administration for too long attributed the attack to a spontaneous and unorganized mob. The firebombing of the poorly secured consulate resulted in the death of four US diplomats, including the US ambassador to Libya, Chris Stevens.

The head of the US National Counterterrorism Center, Matthew Olsen, also said in congressional testimony last week that the attack was ?terrorism,? and he cited Al Qaeda. But he said only that information suggested individuals involved in the attack might have had some level of contact with Al Qaeda and its affiliates ? in particular, Al Qaeda in the Islamic Maghreb (AQIM).

In his speech to the UN General Assembly Tuesday, President Obama said the attack on Benghazi was an attack ?on America," and he said the US would be ?relentless in tracking down the killers and bringing them to justice," but he provided no insight into who the killers were.

In her comments Wednesday, Clinton said the US is working with a number of countries including Libya to find the perpetrators of the attack, while also ?stepping up our counterterrorism efforts across the Maghreb and Sahel.?

Some intelligence specialists have suggested that the attack could have been the work of Ansar al-Sharia, a Libyan jihadist group. During the chaotic period following Libya?s revolution, the group could have had access to the heavier arms used in the consulate attack.

Libya?s president, Mohamed Magariaf, has insisted that the attack was the work of AQIM. The Al Qaeda affiliate originated in Algeria, but intelligence officials say it has been expanding eastward and southward as instability has seized North Africa and the Sahel.

Clinton made clear in her remarks Wednesday that US concerns about the spread of Islamist extremism in the region predate the Benghazi attack.

The US, she said, is ?expanding our counterterrorism partnerships to help countries meet their own growing threats.? She added that the US is ?taking aim at the support structure of Al Qaeda and its affiliates ? closing safe havens, cutting off finances, countering their ideology and denying them recruits.?

A Guide To Outsourcing Work For Small Businesses | appreviews4u ...

Should you outsource work?

Image: Stuart Miles / FreeDigitalPhotos.net

Whether you have a small project, small business or a large commercial business, the decision to outsource work may be one of the best decisions you?ll ever make.

First of all, let me tell you of my experience in outsourcing work. I run a website, produce apps and I?m currently producing an indie movie. I only started outsourcing work about a year ago and in that year I have gained experience on the mostly ups, and sometimes downs of outsourcing. This article is subjective and is written off of the back of the experiences I?ve had personally in outsourcing work.

I won?t beat around the bush here. I was once like many other people producing projects and was thinking: ?I?ll never find anyone who would be willing to put the work in and enthusiasm that I do on specific tasks within a project.? Well, I was wrong, because that all changed ?when I started to give outsourcing a tentative try, to the present day where I am now outsourcing a lot of tasks. I?ve outsourced graphics, research, articles, videos and a whole host of other project components.

Here is a list of the positive aspects of outsourcing . . .

A Win/Win Situation

In response to my old way of thinking that no-one would be as energetic and enthusiastic in completing a task within a given project as I was, working on my personal project. Well, the business or self employed service provider is working on a project him or herself too . . . I?ll repeat that key phrase here. . .they are usually building a project themselves. They are trying to build the best service possible and want you to be happy, just as you probably are. You can outsource work to speed up your project and they in turn add you as a happy client if they do a great job. They then build up their business and cultivate word of mouth contacts, gain experience, build a portfolio and become trusted specialists to boot.

For example, let?s say you hire an up and coming web designer. He does a great job and you are happy with his work. In turn he gains profit and reinvests it into his business project. You also recommend this business or person to friends or contacts. Your website is also featured in a portfolio in that web designer?s array of completed works. Whose project benefits the most? The answer is that both of your projects are mutually benefited. It?s a win/win situation!

Specialisation

Let?s look at the outsourcing to a talented web designer scenario. Well, it?s real for me right now because I have teamed up with a good web designer ?- Octavian Rista at Laeta Designs to redesign an app promotion and landing page. Could I design this website on my own? Yes, with a considerable amount of time spent going around a time-consuming learning curve that would seriously eat up my time. Plus, an experienced web designer has had more experience than me and will come up with ideas that would take me ages to think up.

A specialist will be faster too. In fact, an experienced web designer will be up to 5 times faster than I would be with my limited experience in constructing websites regularly.

You Can Choose Your Team

How often have you been asked at an interview this hackneyed corporate question: ?Are you a team player. Can you work as a team?? How many people answer ?No, I prefer working on my own without interference.? The answer is that no-one, unless they have poor social skills would answer in this way. Instead, we give the hackneyed reply . . . ?Yes, I work well as a team and on my own too.? Yawn. It is one of the dumbest questions I?ve ever been asked and it is so automated and impractical. Of course we can work well in a team if the team is a great team. If it?s a dysfunctional team it can be a nightmare!

Here?s the beauty of outsourcing . . . you can build a ?really cracking team right from the start. You can look for like-minded people and really create that corporate hackneyed phrase ?synergy? fly in the real world, with real results.

As well as your team being built, the person doing business with you, however large or small has added you to their team too! That?s real teamwork, not a corporate mismatch through automated-like interview selection, eventually patching a team together who are stabbing each other in the back to race up the corporate ladder, due to deliberate attempts by corporations to get ?team members? in competition with each other ? disguised with such hackneyed titles such as ?Employee of the month? or ?Tops seller? with even a grade added such as ?Level 1 achiever? etc, etc.

It?s fun!

When you?ve found specialists and built a solid, real relationship with your partners you can really enjoy talking to like-minded people who have enthusiasm and their interests are following a close line parallel to your interests. You are helping each other in various ways and you make real friends. This is in stark contrast to the 1000 Facebook friends who would not even attend your own funeral, let alone notice that you?ve even kicked the bucket.

When you make a connection with someone like-minded and are working on a project together, which is mutually beneficial, it can be really fun. In fact, you can learn a lot from each other in the process.

Make Real Connections

That?s right, you can make real connections. Have you ever watched one of those sales guys or girls handing out business cards whilst drinking free coffee and cookies at a trade show or business convention. Revisit the convention next year and the chances are you will see the same sales reps doing the same exact thing. Yes, they drum up some business and link their employers with services. But you have an advantage, you are not linking up with people via some 3rd party employer. You are linking up 1 to 1. In fact, a smarter approach, instead of handing business cards out at events would be to ask yourself ?How can I help this person? And how can we help each other?? If a workable answer comes forth, approach them personally, as this is better than handing out 100 business cards, with %99 percent of the business cards being thrown in the bin.

I have never printed out business cards and never intend to either. In my view it is better to buy a beer for someone you can actually help and write down your email address or Facebook URL on a napkin whilst having a laugh and give it to them personally. First of all, if they feel the same way they will contact you for sure. If they have any doubts they will not. You will also have a genuine personal relationship with them and they know you as a person, which is a lot stronger than being just a ?contact?.

You may raise the question . . . yes, but they are not real friends as you both mutually need something. Well, this concept falls short in a number of areas. If you give your phone number to a hot girl/guy, is it because you don?t want anything? No. Your are interested in a relationship with them if you find them attractive. Would you hand your phone number over to a girl/guy who doesn?t keep up their personal hygiene? No. You are both looking for someone to share experiences with, to swap ideas, get a feel good factor going.

In any scenario you have to bring something to the table. Be it mutual friendship, a relationship or even an interest in mutually swapping points of view. That?s real life. Outside of your 9 to 5 job, that?s reality, you don?t waste time unless you can both grow from a friendship or relationship or even a business relationship. In fact, even if relationships start out to be a business project, if you make a connection and become a friend, well . . . that?s a win/win/win situation because you can help each other on projects, plus both enjoy a friendship and productive working relationship at the same time.

You Are Already Outsourcing (whether you are aware of it or not)

You may think . . . I?m new to this outsourcing thing, but are you? When you take your car in for a service, could you do it yourself? Of course you could change the oil, check the fluid levels and maybe even change the break pads and steam clean your engine if you put your mind to it. All you have to do is research how to do this, buy a steam cleaning machine, some brake pads, fluids and oil and off you go. But, what do you do ? you outsource the work as you don?t have time.

When you go to a local cafe and order a coffee and a sandwich. Part of the treat here is that you are paying for the privilege of relaxing. You don?t have to make the coffee or butter the sandwich, someone is doing it for you and their business is benefiting as a result. What about when you are on holiday and use the laundry service. Same thing again.

Disadvantages of outsourcing . . .

You?ll get the odd disappointing result of a service or a task. That?s life. Cross them off of your list and move on to finding the right team members.

People/services change. Sometimes, someone who you have been working with for a while may change, or take a different route in life. Never mind, remain friends and enjoy the ride while it lasts. You may even hook up again in an area where you are both working on in the future. People move on and you are not tied to each other, so give your team space and they will in turn give you space to take different tangents in life.

Delivery times: Sometimes there will be a late delivery as you are not in control of the process. I would outsource only work where there is not a stressful delivery date looming. If you want more control on delivery dates for a task within a project, either specify a delivery date way before you actually need it, or employ staff where you can control the process.

In Conclusion

So, in a nutshell, it may be worth looking at other areas of your work/business that could benefit from outsourcing. It is a circle that is ongoing . . . some people outsource to you, as in when I do app reviews on this site, and sometimes you will outsource to others.

Above all, it?s fun! Enjoy the ride.

Doctors on Call: What you need to know about thyroid cancer

J. Gary Evans

The thyroid is a butterfly-shaped gland at the front of your neck just below the Adam?s apple. A healthy thyroid is a little larger than a quarter and usually can?t be felt through the skin.

It might be small, but it?s important.

The thyroid, part of the endocrine system, makes hormones that affect heart rate, blood pressure, metabolism, body temperature and weight.

Many people have benign growths or nodules in their thyroids. But the nodules can also be malignant. Thyroid cancer is the ninth most common type of cancer in the U.S., but it is the fastest increasing cancer in men and women. Here are some facts to know about thyroid cancer:

How common is thyroid cancer?
Thyroid cancer accounts for 1 percent of malignancies diagnosed in the United States each year. The American Cancer Society estimates 56,460 new cases of thyroid cancer and 1,780 deaths from thyroid cancer in the United States for 2012. Although the incidence of thyroid cancer has more than doubled over the past 30 years, part of the increase is related to earlier diagnoses now made possible with readily available diagnostic imaging, such as thyroid ultrasonography.

Who is at risk for thyroid cancer?
Thyroid cancer can affect any age group, but appears to be more common in young and middle adulthood. Two-thirds of those diagnosed with thyroid cancer are between 20 and 55 years old. Women are affected three times as often as men. People with a family history of thyroid cancer or a prior history of radiation treatment or exposure (particularly to the head and neck) are also at a higher risk for thyroid cancer.

What are the symptoms of thyroid cancer?
Thyroid cancer may not cause any symptoms at all in its early development. As the cancer grows in size, however, it is likely to cause symptoms, typically developing into a growing nodule or lump, which increases in size over time. The nodules may be seen or felt at the front of the neck. Enlargement or swelling of the neck, enlarged lymph nodes, hoarseness, difficulty swallowing, difficulty breathing and pain in the neck or throat can be prominent symptoms.

What do nodules have to do with cancer?
A thyroid nodule is a lump or growth within the thyroid gland. Thyroid nodules are very common; they are found in 4 to 8 percent of adults on physical examination, and can be seen in 20 to 40 percent of patients via ultrasound. Sometimes thyroid nodules are found incidentally by other tests such as carotid dopplers, CAT scans or MRI?s of the neck and chest. The risk of a thyroid nodule being a thyroid cancer is about 5 percent, though the risk of cancer can be higher if other risk factors and symptoms are present.

How is thyroid cancer diagnosed?
Patients with thyroid nodules that are palpable or approach 1 centimeter in size or larger should undergo a thyroid fine needle aspiration (FNA), which is generally performed with ultrasound guidance. Smaller nodules can also be sampled by FNA depending on location, or are often simply monitored for any size change by a follow-up thyroid ultrasound.

The thyroid FNA uses a very small needle and does not require any sedation or pain medication. A pathologist looks at the specimen under the microscope and determines if the nodule is benign or malignant (cancerous). If the FNA is not able to establish the diagnosis, some patients may need to undergo a surgical biopsy, where part of the thyroid containing the nodule is removed.

How is thyroid cancer treated?
When thyroid cancer has been diagnosed patients are referred to an experienced thyroid surgeon for surgical removal of the gland. During surgery, lymph nodes in the neck may also be removed and tested for cancer cells. Most patients undergo radioactive iodine treatment after surgery to reduce the likelihood of cancer recurrence.

The survival/cure rate for the most common forms of thyroid cancer is excellent and approaches 95 percent with appropriate care.

Iran's president dismisses threats on nuke program

NEW YORK (AP) ? Iranian President Mahmoud Ahmadinejad on Monday dismissed threats of military action against Iran's nuclear program, arguing that his country's project to enrich uranium is only for peaceful purposes and saying that Iran has no worries about a possible Israeli attack.

Ahmadinejad spoke before a group of editors and news executives after his arrival in New York for the annual U.N. General Assembly. He told the group that it was not too late for dialogue with the United States to resolve differences.

But in his remarks, Ahmadinejad sought to delegitimize U.S. ally Israel's historic ties to the Middle East and its political and military power in the region and the world, saying that Israelis "do not even enter the equation for Iran."

"Fundamentally, we do not take seriously threats of the Zionists," said Ahmadinejad. "We believe the Zionists see themselves at a dead end and they want to find an adventure to get out of this dead end. While we are fully ready to defend ourselves, we do not take these threats seriously."

Ahmadinejad declared Israel has no place in the Middle East, saying that Iran has been around for thousands of years while the modern state of Israel has existed only for the last 60 or so years. "They have no roots there in history," he said.

White House press secretary Jay Carney responded to Ahmadinejad's remarks, telling a midday news briefing, "Well, President Ahmadinejad says foolish, offensive and sometimes unintelligible things with great regularity. What he should focus on is the failure of his government of Iran to abide by its international obligations, to abide by United Nations Security Council resolutions."

U.N. Secretary-General Ban Ki-moon had met with Ahmadinejad on Sunday and "urged Iran to take the measures necessary to build international confidence in the exclusively peaceful nature of its nuclear program," U.N. spokesman Martin Nesirky said. The U.N. chief also raised the potentially harmful consequences of inflammatory rhetoric "from various countries in the Middle East," Nesirky said.

On other topics in his meeting with editors, Ahmadinejad said that Iran favors a negotiated settlement to the civil war in Syria, and denied that Tehran is providing weapons or training to the government of President Bashar Assad, as Assad's opponents and others have alleged.

"We like and love both sides, and we see both sides as brothers," he said. He referred to the conflict in Syria as "tribal" fighting and said that international "meddling from the outside has made the situation even harder." He refused to say whether Iran would accept a government not led by the Assad regime, which for years has been Iran's closest ally in the Middle East.

Ahmadinejad met journalists in the mid-town hotel where he was saying. It was Ahmadinejad's eighth visit to the U.N. gathering held each September, which he cited as proof that he is open to understanding other countries' views.

In spite of his assertions on the importance of dialogue and respect for others, Ahmadinejad presented a hard line in many areas. He refused to speak of the state of Israel by name and instead referred only to the "Zionists," and when asked about author Salman Rushdie he made no attempt to distance himself from recent renewed threats on the author's life emanating from an Iranian semi-official religious foundation. "If he is in the U.S., you should not broadcast it for his own safety," Ahmadinejad said.

He said this would be his last trip to New York as president of Iran, because his term is ending and he is barred from seeking a third consecutive term. But he did not rule out staying active in Iranian politics and said he might return as part of future Iranian delegations to New York.

Ahmadinejad said the argument over Iran's nuclear program was a political rather than a legal matter and needs to be resolved politically.

"We are not expecting that a 33-year-old problem between America and Iran to be resolved in speedy discussions, but we do believe in dialogue."

Later in the day, Ahmadinejad took aim at both the United States and Israel while addressing a high-level U.N. meeting promoting the rule of law, accusing Washington of shielding what he called a nuclear-armed "fake regime." His remarks prompted a walkout by Israel's U.N. Ambassador Ron Prosor.

"Ahmadinejad showed again that he not only threatens the future of the Jewish people, he seeks to erase our past," Prosor said in a statement. "Three thousand years of Jewish history illustrate the clear danger of ignoring fanatics like Iran's president, especially as he inches closer to acquiring nuclear weapons."

Ahmadinejad also alluded to the amateur anti-Islam video made in the U.S. that has caused protests across the Muslim world, accusing the United States and others of misusing freedom of speech and failing to speak out against the defamation of people's beliefs and "divine prophets."

Sweet times for cows as gummy worms replace costly corn feed

KANSAS CITY, Missouri (Reuters) - Mike Yoder's herd of dairy cattle are living the sweet life. With corn feed scarcer and costlier than ever, Yoder increasingly is looking for cheaper alternatives -- and this summer he found a good deal on ice cream sprinkles.

"It's a pretty colorful load," said Yoder, who operates about 450 dairy cows on his farm in northern Indiana. "Anything that keeps the feed costs down."

As the worst drought in half a century has ravaged this year's U.S. corn crop and driven corn prices sky high, the market for alternative feed rations for beef and dairy cows has also skyrocketed. Brokers are gathering up discarded food products and putting them out for the highest bid to feed lot operators and dairy producers, who are scrambling to keep their animals fed.

In the mix are cookies, gummy worms, marshmallows, fruit loops, orange peels, even dried cranberries. Cattlemen are feeding virtually anything they can get their hands on that will replace the starchy sugar content traditionally delivered to the animals through corn.

"Everybody is looking for alternatives," said Ki Fanning, a nutritionist with Great Plains Livestock Consulting in Eagle, Nebraska. "It's kind of funny the first time you see it but it works well. The big advantage to that is you can turn something you normally throw away into something that can be consumed. The amazing thing about a ruminant, a cow, you can take those type of ingredients and turn them into food."

PRICING VARIES

Feed is generally the largest single production expense for cattle operators. Whatever is fed needs to supply energy and protein levels that meet the animals' nutritional needs. High prices for soy has operators seeking alternatives for both corn and soy.

Corn alternatives are in particular demand as supplies are so tight that in some areas of the country, feed corn is not available at any price.

Pricing and availability of the many different "co-products" as they are called, varies from place to place, but buyers report savings of 10 percent to 50 percent.

The savings for operators are shrinking, however, as savvy resellers tie pricing for their alternative offerings to the price of corn, which surged to record highs this summer due to drought damage.

The U.S. Department of Agriculture said last month the harvest now underway will yield the smallest corn crop in six years due to the drought that is still gripping more than half of the nation.

"They are using less corn in a number of these rations, but as corn prices go up, prices for really every other co-product go up too," said Greg Lardy, head of the animal sciences department at North Dakota State University.

Operators must be careful to follow detailed nutritional analyses for their animals to make sure they are getting a healthy mix of nutrients, animal nutritionists caution. But ruminant animals such as cattle can safely ingest a wide variety of feedstuffs that chickens and hogs can't.

The candy and cookies are only a small part of a broad mix of alternative feed offerings for cattle. Many operators use distillers grains, a byproduct that comes from the manufacture of ethanol. Other common non-corn alternatives include cottonseed hulls, rice products, potato products, peanut pellet.

Wheat "middlings," a byproduct of milling wheat for flour that contain particles of flour, bran, and wheat germ, also are fed.

And every now and then, there is a little chocolate for the hungry cows.

Hansen Mueller Grain out of Omaha, Nebraska, which markets chocolate bars alongside oats and peanut pellets, said it all comes down to fat, sugar and energy.

"That's all it is," said Bran Dill, a spokesman at Hansen Mueller. Demand is high, he said.

But he also said increasing prices are making alternatives less attractive.

"The price of this stuff has gone up so much it's gotten ridiculous," he said.
